USDA has issued guidance on how the final rule titled Nutrition Standards in the National School Lunch and School Breakfast Programs impacts current contracts between school food authorities (SFAs) and food service management companies (FSMCs). Using this guidance to review the current FSMC contracts in Texas, TDA has determined a material change is required to the standard contract for those SFAs that use Nutrient Standard Menu Planning.
For school year 2012-2013, there are two options for those SFAs:
- amend the current contract during the annual renewal process to ensure full implementation of the final rule specifications and rebid for school year 2013-2014, or
- rebid for school year 2012-2013 to ensure full implementation of the final rule specifications.

As a reminder, FSMCs may not participate in the procurement process through drafting the procurement specifications, procedures, or documents, such as requests for proposal, invitations for bids, and contracts. If a FSMC participates in any of these areas they are rendered ineligible to bid.
